Resolved Question: My 2009 Tax Return was accepted... now what?

I received a deficiency notice because there were wages reported to the IRS that were not on our 2007 return. This has been a problem in passed years (2003,2004) and were cleared up without ever getting to the point of sending out a deficiency notice. I submitted my petition to go to Small Tax court because this an an identity issue and can prove that these wages were not earned by my husband. The IRS center handling this is in Ogden, UT which is notorious for being sticklers. They sent me a packet two weeks ago saying my case was going to Appeals because I did not state in the petition where the notice came from - wtf kind of crap is that?(in other words, they stuck to their decision that I should pay) and that I'd be hearing from someone soon. I made a trip to my closest IRS office and took all the necessary documentation that I thought would help my case (police report, affidavit, paperwork for 2003/2004 tax advocate etc.) no more than a few days later I get a phone call from my appeals officer who says "I don't understand why this wasn't closed" after explaining that we've had to clear this mess up before. She said she'd be mailing an authorization form for us to sign so she could make contact with the Employers who are reporting these wages. She also stated that she'd need a copy of our DL & SS card along with anything else I thought would help as she was convinced that this was indeed a case of Identity theft. With this being said I haven't heard from her anymore and I've left messages for her because I'd like to know if my case is pretty much wrapped up (at least it sounds that way) and the appeals officer only needs to make contact with these employers - Will I get my refund?
